Licensing and Registration Rules

LICENSED PROGRAMS
Licensed group family day care homes, day care centers, and before and after school centers are required to obtain a license prior to operating the program.  The requirements to be met by these programs to obtain a license are outlined in the following South Dakota Codified Laws (SDCL) and Administrative Rules of South Dakota (ARSD):

SDCL pertaining to all types of licensed programs:  Chapter 26-6
ARSD for Group Family Day Care Homes licensed for 13 to 20 children: 

ARSD for Day Care Centers licensed for 21 or more children: 

ARSD for Before and After School Centers licensed for school children only: 

REGISTERED PROGRAMS
Family home providers are limited to 12 or fewer children regardless of the number of helpers present and regardless of whether they are registered with the department or not.  The requirements to be met by providers choosing to be registered with the department are outlined in the following South Dakota Codified Laws (SDCL) and Administrative Rules of South Dakota (ARSD):
