Legal Services

The Division of Legal Services provides legal services to the department secretary as well as to other programs within the department. The division also administers discrimination complaints, public records requests, HIPAA and works closely with the Division of Child Protection Services to facilitate the reduction of incidents of child abuse and neglect in South Dakota.    

The division also represents the department in administrative and court hearings at both the trial and appellate levels.

  • Discrimination Complaints
    Ensures program services and benefits are available to every qualified applicant without regard to race, color, sex, age, disability, religion and national origin.
  • Health Insurance Portability and Accountability Act (HIPAA)
    Ensures the confidentiality of individual health information and increases their access to personal medical records.
  • Public Records Requests
    Ensures all open and public record requests are handled in a timely and effective manner based on the intent of the request.
