The Division of Legal Services provides legal service to the Department Secretary and various department programs with first priority going to the Division of Child Protection Services to facilitate the reduction of incidents of child abuse and deter the commission of offenses against children in South Dakota.    

The Division of Legal Services also represents the Department in administrative and court hearings at both the trial and appellate levels.

• Administrative Rules
  Administrative Rules are statements of general applicability; which implement, interpret, or prescribe the actions that may be taken by the programs administered by the Department.
• Catastrophic County Poor Relief Program
  Allows counties to pool their resources into a central fund in order to provide relief for catastrophic medical expenses.
• Discrimination Complaints
  Ensures program services and benefits are available to every qualified applicant without regard to race, color, sex, age, disability, religion and national origin.
• Health Insurance Portability and Accountability Act (HIPAA)
  Ensures the confidentiality of individual health information and increases their access to personal medical records.
