The South Dakota Board of Examiners for Counselors and Marriage & Family Therapists will meet on April 21, 2014 at 12:00 noon by teleconference.

NOTICE OF PUBLIC HEARING
DEPARTMENT OF SOCIAL SERVICES
(Proposed: May 08, 2014)

   A public hearing will be held in the Kneip Conference Room 1, Kneip Office Building, 700 Governors Drive, Pierre, South Dakota on May 08, 2014, at 2:00 p.m., to consider the amendment of the following Child Care Assistance rules:

     Chapter 67:47:01. §§ 67:47:01:01, 67:47:01:03.01, 67:47:01:13, and 67:47:01:17.

This meeting is being held in a physically accessible place.  Individuals needing assistance, pursuant to the Americans with Disabilities Act, should contact the Legislative Research Council (605-773-3251) in advance of the meeting to make any necessary arrangements.

The effects of these rules will be to include within the definition of a “relative provider” a caretaker who is a sibling of the child, rather than including such a sibling within the definition of “informal provider”, to establish that 15 semester credit hours at a college, university or technical institute is sufficient to meet the eligibility requirements for work and education to receive child care assistance, and to increase the time period during which a recipient must notify the department of a change in child care providers.   The rules are being amended to more appropriately reference care by a sibling and to clarify school eligibility and reporting requirements.

            Chapter 67:10:05. §§ 67:10:05:03, 67:10:05:05.

The effect of these rules will be to update payment standards regarding the Temporary Assistance for Needy Families program.  These rules are being updated to be consistent with inflation policy.

    A public hearing will be held in the Kneip Conference Room 1, Kneip Office Building, 700 Governors Drive, Pierre, South Dakota on May 08, 2014, at 3:00 p.m., to consider the amendment of the following Medical Services rules for covered medical services for physician and other health services and for covered medical services for school districts:

Chapter 67:16:02, §§ 67:16:02:03 and 67:16:02:03.02; and Chapter 67:16:37, §§ 67:16:37:01, 67:16:37:03, 67:16:37:05, 67:16:37:10.01, 67:16:37:11, 67:16:37:14, and 67:16:37:15.

This meeting is being held in a physically accessible place.  Individuals needing assistance, pursuant to the Americans with Disabilities Act, should contact the Legislative Research Council (605-773-3251) in advance of the meeting to make any necessary arrangements.

The effects of these rules as to covered medical services for physician and other health services will be to move the rate for anesthesia services to the fee schedule on the department’s website and to remove invalid modifier codes.  The effect of these rules as to covered medical services for school districts is to update terminology and licensing requirements for psychological evaluators, speech-language pathologists, speech-language pathology assistants, and audiologists and to remove redundant supervision requirements, to update terminology for care plans and to clarify the requirements of a care plan, to specify that covered nursing services include only those provided to treat a chronic medical illness and to remove the limit on the allowable units per day for covered nursing services, and to move the procedure codes for covered services to the department’s website.  The rules are being amended to update provisions and to align with terminology and requirements of the South Dakota Department of Health and South Dakota Department of Education.

    A public hearing will be held in the Kneip Conference Room 1, Kneip Office Building, 700 Governors Drive, Pierre, South Dakota on May 08, 2014, at 3:30 p.m., to consider the amendment of the following Recoveries and Investigations rule relating to liens and estate recoveries:

            Chapter 67:48:02. §67:48:02:01.

The effects of the rule will be to delete from the definition of an “estate” the reference to SDCL 10-40-1, which was repealed during the 2014 legislative session effective July 1, 2014, to update the definition of an “estate” to include the definition in SDCL 29A-1-201 and other property or assets in which the individual had any legal title or interest, and to clarify the amount included in the “estate” from funds for prepaid burial expenses.  The rule is being amended to insure continued alignment with the expanded definition of estate under 42 USC 1396p(b)(4), and for consistency with current practice.

Notice of Public Hearings to Adopt Rules

A public hearing will be held on Monday, May 12, 2014, at 3:00 p.m. in Pierre, SD, at the Department of Social Services Office, Conference Room 2, Kneip Building, 700 Governor’s Drive, Pierre, SD  57501, to consider the adoption and amendment of the following proposed rules:
           
            Amendment of sections §§ 46:11:13:01 to 19 inclusive; 46:20:34:03; and 46:20:34:05.

            The effect of these changes will be to: update rules relating to Preadmission Screening and Resident Reviews including updating criteria for exemptions from reviews, updating the explanation of the review process and requirements, clarifying the determination and notification process for needed services, updating the appeal process, updating the length of stay requirements, updating the admission and facility transfer process, clarifying residency requirements, and updating terminology.
